Terms of Service

1. Acceptance
By creating an account or using nextroof, you agree to these Terms. If you are using nextroof on behalf of a business, you represent that you have authority to bind that business. These Terms apply across all nextroof products: web app, mobile app, and API.
2. The service
nextroof provides a property management platform for agents, landlords, tenants, and contractors. Features include property listings, tenancy management, rent collection, AI-powered insights, and contractor management. We may add, modify, or remove features at any time with notice.
3. Your account
You must be at least 18 years old to use nextroof. You are responsible for maintaining the security of your account credentials. Notify us immediately at security@nextroof.co.uk if you believe your account has been compromised. You may not share accounts or create multiple accounts for the same person.
4. Agent and agency terms
Agents using nextroof must hold the appropriate licence (ARLA Propertymark, NAEA, or equivalent). You are responsible for ensuring all properties listed comply with UK housing legislation including the Housing Act 2004, Homes (Fitness for Human Habitation) Act 2018, and all applicable HMO regulations. nextroof is a technology platform — it is not a regulated property agent and does not provide legal or financial advice.
5. Landlord obligations
Landlords are solely responsible for compliance with all legal obligations including but not limited to: Gas Safety (annual certificate), Electrical Safety (EICR every 5 years), Energy Performance Certificate, deposit protection (within 30 days), Right to Rent checks, and HMO licensing where applicable. nextroof's compliance tracking tools are a convenience — they do not constitute legal advice.
6. Payments
Rent and fee payments are processed by Stripe (UK/Global) or Paystack (Africa). nextroof does not store card numbers. Payment disputes must first be attempted to resolve through nextroof's resolution process before escalating to your payment provider. For diaspora transfers, exchange rates are live market rates at time of transfer — nextroof charges a 0.5% fee, transparently disclosed.
7. AI features (Kiki)
Kiki AI provides insights including rental valuations (AVM), arrears predictions, and lead scoring. These are AI-generated estimates — not professional valuations or legal advice. Decisions based on Kiki outputs remain your responsibility. Kiki AVM is not a formal RICS valuation.
8. Blockchain documents
Documents anchored to the Polygon blockchain via nextroof's Digital Handshake feature are designed for verification purposes. A blockchain hash confirms document integrity at the time of signing — it does not constitute legal enforceability in all jurisdictions. You should obtain independent legal advice for high-value agreements.
9. Intellectual property
nextroof Limited owns all IP in the platform. You retain ownership of data you upload. By uploading content (photos, documents, descriptions), you grant nextroof a licence to host and serve that content for the purpose of operating the service.
10. Prohibited use
You may not use nextroof to: list properties you do not have legal authority to let or sell, discriminate unlawfully against applicants, engage in money laundering or financial crime, scrape or systematically extract data, attempt to reverse-engineer or compromise platform security, or impersonate another person or entity.
11. Liability
nextroof's liability is limited to the subscription fees paid in the preceding 12 months. We are not liable for indirect or consequential losses. We do not guarantee uninterrupted service but target 99.9% uptime. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
12. Termination
Either party may terminate with 30 days' notice. nextroof may suspend accounts immediately for serious breach (fraud, illegal activity, repeated payment failure). On termination, you retain the right to export your data for 30 days. After 30 days, data is deleted per our retention schedule.
13. Governing law
These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
